Our Company: Terms and Conditions

Last Updated: 20 September 2026

These Terms and Conditions apply to all bookings made with Nusa Penida Islands Tours through our website, email, WhatsApp, telephone, social media, or authorized representatives.

By making a booking or payment, the customer confirms that they have read, understood, and accepted these Terms and Conditions on behalf of every participant included in the booking.

1. Tour Operator

Nusa Penida Islands Tours provides private tours, shared tours, snorkeling trips, island-hopping tours, liveaboard expeditions, hotel arrangements, land transportation, boat transfers, domestic flights, and other travel services across Indonesia.

Some services may be provided by independent partners, including hotels, airlines, fast-boat operators, liveaboard operators, local guides, drivers, and activity providers.

2. Booking Confirmation

A booking is not confirmed until:

  • We confirm availability in writing;
  • The required payment has been received;
  • The customer provides the requested passenger information; and
  • We issue a booking confirmation, invoice, or payment receipt.

An itinerary, quotation, or availability message does not guarantee a reservation before payment.

Tour spaces, boats, hotel rooms, and flight seats remain subject to availability. Prices and availability may change until the booking has been confirmed.

3. Passenger Information

Customers must provide complete and accurate information for every participant. This may include:

  • Full name as shown on the passport;
  • Nationality;
  • Passport number and expiry date;
  • Date of birth;
  • Hotel details;
  • Flight information;
  • Dietary requirements;
  • Medical conditions; and
  • Emergency contact details.

Customers are responsible for any costs caused by incorrect or incomplete information.

4. Prices

All prices apply only to the services stated in the confirmed itinerary or invoice.

Unless clearly stated otherwise, prices do not include:

  • International flights;
  • Visa fees;
  • Travel insurance;
  • Personal expenses;
  • Alcoholic drinks;
  • Optional activities;
  • Tips;
  • Excess baggage charges; or
  • Services not listed under the tour inclusions.

Prices may vary due to changes in government taxes, national park fees, fuel prices, airline fares, exchange rates, or supplier charges. We will inform the customer if a necessary change occurs before final confirmation.

After full payment, we will not request an additional payment unless the customer changes the booking or a new compulsory government charge takes effect.

5. Payment Terms

The required deposit or full payment amount will be stated in the quotation or invoice.

Unless a different arrangement has been confirmed in writing:

  • Full payment must be completed within two weeks of making the booking;
  • Bookings made close to the departure date may require immediate full payment;
  • A staged-payment arrangement may be available when the booking is made more than one month before departure;
  • The remaining balance must be paid by the deadline shown on the invoice; and
  • Payment cannot be made on the activity date.

A booking may be cancelled automatically if payment is not received by the stated deadline.

Bank charges, card fees, PayPal fees, currency-conversion fees, and other transaction costs are the customer’s responsibility unless otherwise stated.

6. Cancellation by the Customer

All cancellation requests must be submitted in writing.

Unless different terms appear in the quotation or invoice:

  • Deposits and payments are non-refundable after the reservation has been confirmed;
  • Private boat and liveaboard payments are non-refundable;
  • Flight tickets are non-refundable and non-changeable unless the airline’s fare conditions allow changes;
  • Hotel, fast-boat, permit, and activity fees remain subject to each supplier’s cancellation conditions; and
  • No refund applies to unused services, late arrival, early departure, voluntary itinerary changes, or failure to join the tour.

Bookings during high season, especially in July, August, Christmas, New Year, and other peak periods, may require full non-refundable payment.

If the customer cannot travel, we will try to request a date change from the suppliers. However, approval is not guaranteed. Additional charges or price differences may apply.

7. Cancellation or Changes by Us

We may change the itinerary, departure time, transportation, accommodation, boat, snorkeling location, or activity when necessary because of:

  • Unsafe sea or weather conditions;
  • Natural disasters;
  • Volcanic activity;
  • Government restrictions;
  • National park closures;
  • Mechanical problems;
  • Flight or fast-boat disruption;
  • Supplier cancellation;
  • Safety concerns; or
  • Other circumstances beyond our reasonable control.

When possible, we will provide a suitable alternative of similar value.

If we cancel a service that we operate and cannot provide a reasonable alternative, we will refund the amount paid for the affected service. However, we are not responsible for additional expenses such as international flights, separate hotel bookings, visas, or other arrangements made independently by the customer.

8. Weather and Sea Conditions

Tours involving boats, snorkeling, diving, liveaboards, and island transfers depend on weather and sea conditions.

The captain, guide, harbour authority, or local operator has the final authority to change or cancel a route when conditions are unsafe.

Specific locations cannot be guaranteed. For example, if Manta Point is unsafe, the team may visit Manta Bay or another suitable snorkeling location.

A route change made for safety reasons does not automatically qualify for a refund when the tour can continue using a reasonable alternative itinerary.

9. Wildlife Encounters

Indonesia’s wildlife lives freely in its natural environment. Therefore, sightings of manta rays, whale sharks, Komodo dragons, orangutans, dolphins, mola mola, birds, and other wildlife cannot be guaranteed.

The absence of a particular animal does not qualify for a refund when the scheduled activity has been provided.

Customers must follow all wildlife-interaction rules and maintain a respectful distance from animals.

10. Flights and Transportation

Flight schedules may change without prior notice. Airlines control all flight cancellations, delays, baggage allowances, and ticket changes.

We are not responsible for disruptions caused by airlines or independent transport companies. However, we will provide reasonable assistance when possible.

Customers should allow sufficient connection time between international flights and domestic flights, fast boats, ferries, or liveaboard departures.

11. Hotels, Boats, and Other Suppliers

Photos of boats, cabins, rooms, and vehicles represent the expected service. A supplier may provide a similar replacement when the original service becomes unavailable due to operational or safety reasons.

Facilities and service standards may vary between destinations, especially in remote islands and rural areas.

Room requests, bed types, adjoining rooms, dietary requests, and special facilities remain subject to availability unless we confirm them in writing.

12. Health and Fitness

Customers must ensure that they are physically fit for the selected activities.

Customers must inform us before booking about any:

  • Medical condition;
  • Physical limitation;
  • Pregnancy;
  • Allergy;
  • Dietary restriction;
  • Swimming difficulty; or
  • Need for special assistance.

Some tours include steep steps, uneven paths, strong currents, boat transfers, or remote locations with limited medical facilities.

We may refuse participation when a customer’s condition creates a serious safety risk to themselves or others.

13. Snorkeling and Water Activities

Customers must follow the safety briefing and instructions from the captain and guides.

Life jackets and snorkeling equipment will be provided when included in the confirmed package. Customers who cannot swim or lack confidence in the water must inform us before entering the sea.

A guide may stop a customer from participating if sea conditions, health, conduct, or swimming ability creates an unacceptable risk.

Participation in water activities involves inherent risks. Customers accept these risks when choosing to participate.

14. Diving Activities

Certified divers must present a valid diving certification when required.

Divers must provide accurate information about their experience and medical condition. The dive operator may change or cancel a dive based on weather, currents, certification level, experience, or safety concerns.

Customers must observe the recommended no-fly period after diving. A flight should not be taken immediately after the final dive. The required surface interval depends on the number and type of dives completed.

15. Children and Minors

Children must remain under the supervision of a parent or legal guardian.

The parent or guardian accepts these Terms and Conditions on behalf of every minor included in the booking.

Age restrictions may apply to certain activities, boats, dives, treks, or wildlife experiences.

16. Travel Insurance

We strongly recommend comprehensive travel insurance for every customer.

Insurance should cover:

  • Trip cancellation;
  • Medical treatment;
  • Emergency evacuation;
  • Accidents;
  • Lost or damaged belongings;
  • Flight disruption;
  • Weather-related delays; and
  • Adventure and water activities included in the itinerary.

Any activity insurance included by a local operator may provide limited coverage. It does not replace comprehensive personal travel insurance.

17. Passports, Visas, and Entry Requirements

Customers are responsible for ensuring that they have:

  • A valid passport;
  • The correct Indonesian visa;
  • Required permits;
  • Health documents;
  • Return or onward tickets; and
  • Any other required travel documents.

We are not responsible if a customer cannot travel because of missing, invalid, or incorrect documents.

18. Customer Conduct

Customers must behave responsibly and follow the instructions of guides, captains, drivers, park officers, and other authorized staff.

We may remove a customer from a tour without a refund if their behaviour:

  • Endangers themselves or others;
  • Disturbs other guests;
  • Damages property or the environment;
  • Harasses staff or local communities;
  • Violates Indonesian law; or
  • Ignores important safety instructions.

The customer remains responsible for any loss or damage they cause.

19. Force Majeure

We are not responsible for failure or delay caused by events beyond our reasonable control. These events may include:

  • Extreme weather;
  • Earthquakes;
  • Volcanic eruptions;
  • Tsunamis;
  • Floods;
  • Fires;
  • Pandemics or disease outbreaks;
  • War or civil unrest;
  • Strikes;
  • Government actions;
  • Harbour closures;
  • Transport disruption; or
  • Other unavoidable events.

Refunds, credits, or date changes in these circumstances will depend on the policies of the hotels, airlines, boat operators, and other suppliers involved.

20. Photos and Videos

Our team may take photos or videos during a tour.

We may use general tour images for promotional purposes unless the customer asks us in writing not to use images in which they can be identified.

Customers must obtain permission before using drones. Indonesian aviation, national park, harbour, and local regulations may restrict drone use.

21. Personal Belongings

Customers remain responsible for their passports, money, electronic devices, luggage, and other personal belongings.

We are not responsible for loss, theft, or damage unless it results directly from proven negligence by our company.

22. Website Information

We make reasonable efforts to keep our website, prices, photographs, itineraries, and tour descriptions accurate.

However, conditions, facilities, schedules, entrance fees, and supplier services may change. The latest written booking confirmation and invoice take priority over general information displayed on the website.

23. Complaints

Customers should report any problem to the guide or our customer service team as soon as possible during the trip. This gives us an opportunity to find a solution.

If the issue remains unresolved, the customer should submit a written complaint within seven days after the tour ends. The complaint should include the booking name, tour date, details of the issue, and supporting evidence.

24. Limitation of Liability

We will provide the confirmed services with reasonable care. However, we are not responsible for injury, loss, damage, delay, or additional expenses caused by:

  • The customer’s own actions;
  • Another customer;
  • An independent service provider;
  • Failure to follow safety instructions;
  • Pre-existing medical conditions;
  • Wildlife behaviour;
  • Weather or sea conditions; or
  • Events beyond our reasonable control.

Nothing in these Terms and Conditions limits any rights or liability that cannot legally be excluded under Indonesian law.

25. Governing Law

These Terms and Conditions follow the laws of the Republic of Indonesia.

The parties should first attempt to resolve any dispute through good-faith discussion. If no agreement can be reached, the dispute will fall under the jurisdiction of the appropriate court in Indonesia.

26. Acceptance of These Terms

The person making the booking confirms that they have authority to accept these Terms and Conditions on behalf of every participant included in the reservation.

Payment of a deposit, partial payment, or full payment confirms acceptance of:

  • The confirmed itinerary;
  • The quoted price;
  • The payment schedule;
  • The cancellation conditions; and
  • These Terms and Conditions.
